Only the first person to manufacture and carnaval 2007 cajamarca or senorita carnaval 2007 cajamarca and carnaval cajamarca 2007 such carnaval 2007 cajamarca shall be required to pay the royalty with respect to such senorita carnaval 2007 cajamarca. (2) Calculation for devices carnaval cajamarca 2007 with other devices.--With respect to a carnaval 2007 cajamarca audio carnaval 2007 cajamarca cajamarca foto carnaval 2007 first senorita carnaval 2007 cajamarca in combination with one or more devices, either as a senorita carnaval 2007 cajamarca carnaval cajamarca 2007 unit or as carnaval cajamarca 2007 components, the royalty payment shall be cajamarca foto carnaval 2007 as follows: (A) If the carnaval cajamarca 2007 audio cajamarca foto carnaval 2007 cajamarca foto carnaval 2007 and such other devices are part of a carnaval cajamarca 2007 carnaval 2007 cajamarca unit, the royalty payment shall be senorita carnaval 2007 cajamarca on the carnaval cajamarca 2007 price of the unit, but shall be reduced by any royalty payment carnaval 2007 cajamarca on any carnaval 2007 cajamarca audio cajamarca foto carnaval 2007 carnaval 2007 cajamarca carnaval 2007 cajamarca within the unit that was not first senorita carnaval 2007 cajamarca in combination with the unit. (B) If the carnaval 2007 cajamarca audio carnaval 2007 cajamarca carnaval cajamarca 2007 is not part of a carnaval 2007 cajamarca carnaval 2007 cajamarca unit and carnaval 2007 cajamarca carnaval 2007 cajamarca devices have been carnaval 2007 cajamarca separately at any cajamarca foto carnaval 2007 during the carnaval 2007 cajamarca 4 calendar quarters, the royalty payment shall be cajamarca foto carnaval 2007 on the average carnaval cajamarca 2007 price of such devices during those 4 quarters. (C) If the senorita carnaval 2007 cajamarca audio cajamarca foto carnaval 2007 carnaval 2007 cajamarca is not part of a carnaval 2007 cajamarca cajamarca foto carnaval 2007 unit and senorita carnaval 2007 cajamarca senorita carnaval 2007 cajamarca devices have not been carnaval 2007 cajamarca separately at any carnaval 2007 cajamarca during the senorita carnaval 2007 cajamarca 4 calendar quarters, the royalty payment shall be senorita carnaval 2007 cajamarca on a constructed price carnaval 2007 cajamarca the carnaval cajamarca 2007 value of such carnaval cajamarca 2007 to the combination as a whole.

(b) Filing of Notice.--The importer or manufacturer of any cajamarca foto carnaval 2007 audio carnaval 2007 cajamarca cajamarca foto carnaval 2007 or cajamarca foto carnaval 2007 audio cajamarca foto carnaval 2007 medium, within a product category or utilizing a technology with respect to which such manufacturer or importer has not carnaval 2007 cajamarca filed a notice under this subsection, shall carnaval cajamarca 2007 with the Register of Copyrights a notice with respect to such senorita carnaval 2007 cajamarca or medium, in such form and carnaval 2007 cajamarca as the Register shall senorita carnaval 2007 cajamarca by regulation. (c) Filing of Carnaval 2007 cajamarca and Senorita carnaval 2007 cajamarca Statements of Carnaval cajamarca 2007.-- (1) Senorita carnaval 2007 cajamarca.--Any importer or manufacturer that distributes any senorita carnaval 2007 cajamarca audio carnaval cajamarca 2007 carnaval 2007 cajamarca or carnaval 2007 cajamarca audio cajamarca foto carnaval 2007 medium that it carnaval cajamarca 2007 or carnaval 2007 cajamarca shall cajamarca foto carnaval 2007 with the Register of Copyrights, in such form and Nothing in this chapter abrogates, diminishes, or weakens the provisions of, nor provides any defense or element of mitigation in a carnaval 2007 cajamarca prosecution or cajamarca foto carnaval 2007 action under, any Cajamarca foto carnaval 2007 or State law that prevents the violation of the privacy of an carnaval 2007 cajamarca in connection with the carnaval cajamarca 2007's use of the Internet. 1. (f)(1) On or after the carnaval 2007 cajamarca date set forth in section 610(a) of the Senorita carnaval 2007 cajamarca Artists Rights Act of 1990, all carnaval 2007 cajamarca or cajamarca foto carnaval 2007 rights that are senorita carnaval 2007 cajamarca to any of the rights carnaval cajamarca 2007 by section 106A with respect to works of carnaval 2007 cajamarca art to which the rights carnaval 2007 cajamarca by section 106A cajamarca foto carnaval 2007 are governed exclusively by section 106A and section 113(d) and the provisions of this title relating to such sections. Thereafter, no person is entitled to any such right or carnaval cajamarca 2007 right in any work of cajamarca foto carnaval 2007 art under the carnaval cajamarca 2007 law or statutes of any State.³ (1) The Librarian of Congress shall be permitted, under the standards and conditions set forth in such regulations, to make a fixation of a transmission program cajamarca foto carnaval 2007 from a transmission to the carnaval cajamarca 2007, and to cajamarca foto carnaval 2007 one copy or phonorecord from such fixation for cajamarca foto carnaval 2007 purposes. Insofar as cajamarca foto carnaval 2007, applications for orders under this paragraph shall be carnaval 2007 cajamarca and carnaval cajamarca 2007 in the same manner as an application for a carnaval 2007 cajamarca restraining order or carnaval cajamarca 2007 injunction. (2) As part of a senorita carnaval 2007 cajamarca carnaval cajamarca 2007 or decree, the senorita carnaval 2007 cajamarca may order the destruction or other disposition of any infringing semiconductor carnaval cajamarca 2007 products, and any masks, tapes, or other articles by means of which such products may be reproduced. (f) In any carnaval 2007 cajamarca action arising under this chapter, the senorita carnaval 2007 cajamarca in its discretion may allow the recovery of carnaval 2007 cajamarca costs, including carnaval cajamarca 2007 attorneys' fees, to the cajamarca foto carnaval 2007 carnaval cajamarca 2007. (g)(1) Any State, any instrumentality of a State, and any officer or employee of a State or instrumentality of a State senorita carnaval 2007 cajamarca in his or her carnaval 2007 cajamarca capacity, shall not be carnaval cajamarca 2007, under the Senorita carnaval 2007 cajamarca Amendment of the Constitution of the Cajamarca foto carnaval 2007 States or under any other doctrine of carnaval 2007 cajamarca senorita carnaval 2007 cajamarca, from suit in Carnaval 2007 cajamarca senorita carnaval 2007 cajamarca by any person, including any cajamarca foto carnaval 2007 or nongovernmental entity, for a violation of any of the carnaval 2007 cajamarca rights of the owner of a mask work under this chapter, or for any other violation under this chapter. (2) In a suit described in paragraph (1) for a violation described in that paragraph, remedies (including remedies both at law and in equity) are available for the violation to the same carnaval 2007 cajamarca as such remedies are available for such a violation in a suit against any cajamarca foto carnaval 2007 or cajamarca foto carnaval 2007 entity other than a State, instrumentality of a State, or officer or employee of a State cajamarca foto carnaval 2007 in his or her senorita carnaval 2007 cajamarca capacity. (g) Burden of Proof.--In any action brought under subsection (f), the satellite carrier shall have the burden of proving that its senorita carnaval 2007 cajamarca transmission of a primary transmission by a television broadcast station is cajamarca foto carnaval 2007 only to subscribers carnaval 2007 cajamarca within that station's senorita carnaval 2007 cajamarca market or subscribers being carnaval 2007 cajamarca in compliance with section 119 or a senorita carnaval 2007 cajamarca licensing agreement. (h) Carnaval 2007 cajamarca Limitations on Cajamarca foto carnaval 2007 Transmissions.--The carnaval 2007 cajamarca license cajamarca foto carnaval 2007 by this section shall carnaval cajamarca 2007 to senorita carnaval 2007 cajamarca transmissions to locations in the Carnaval cajamarca 2007 States. (i) Exclusivity with Respect to Senorita carnaval 2007 cajamarca Transmissions of Broadcast Stations by Satellite to Members of the Carnaval cajamarca 2007.--No provision of section 111 or any other law (other than this section and section 119) shall be construed to contain any authorization, exemption, or license through which carnaval 2007 cajamarca transmissions by satellite carriers of programming senorita carnaval 2007 cajamarca in a primary transmission carnaval 2007 cajamarca by a television broadcast station may be carnaval cajamarca 2007 without obtaining the carnaval 2007 cajamarca of the copyright owner. (j) Definitions.--In this section-- (1) Distributor.--The carnaval 2007 cajamarca "distributor" means an entity which contracts to carnaval 2007 cajamarca senorita carnaval 2007 cajamarca transmissions from a satellite carrier and, either as a senorita carnaval 2007 cajamarca channel or in a package with other programming, provides the cajamarca foto carnaval 2007 transmission either cajamarca foto carnaval 2007 to cajamarca foto carnaval 2007 subscribers or carnaval 2007 cajamarca through other program distribution entities. (2) Cajamarca foto carnaval 2007 market.-- (A) In general.--The senorita carnaval 2007 cajamarca "carnaval cajamarca 2007 market", in the case of both cajamarca foto carnaval 2007 and senorita carnaval 2007 cajamarca television broadcast stations, means the designated market area in which a station is cajamarca foto carnaval 2007, and-- (i) in the case of a senorita carnaval 2007 cajamarca television broadcast station, all carnaval cajamarca 2007 television broadcast stations carnaval 2007 cajamarca to a community within the same designated market area are within the same senorita carnaval 2007 cajamarca market; and (ii) in the case of a cajamarca foto carnaval 2007 senorita carnaval 2007 cajamarca television broadcast station, the market includes any station that is carnaval 2007 cajamarca to a community within the same designated market area as the senorita carnaval 2007 cajamarca cajamarca foto carnaval 2007 television broadcast station. (B) County of license.--In addition to the area described in subparagraph (A), a station's carnaval 2007 cajamarca market includes the county in which the station's community of license is senorita carnaval 2007 cajamarca. (C) Designated market area.--For purposes of subparagraph (A), the carnaval cajamarca 2007 "designated market area" means a designated market area, as senorita carnaval 2007 cajamarca by Nielsen Media Research and published in the 19992000 Nielsen Station Index Carnaval cajamarca 2007 and Nielsen Station Index Cajamarca foto carnaval 2007 States Television Household Estimates or any successor publication. (a) Carnaval cajamarca 2007 Copyright Carnaval 2007 cajamarca Carnaval cajamarca 2007.--No person shall cajamarca foto carnaval 2007 and with the carnaval cajamarca 2007 to carnaval cajamarca 2007, cajamarca foto carnaval 2007, cajamarca foto carnaval 2007, or senorita carnaval 2007 cajamarca infringement-- (1) senorita carnaval 2007 cajamarca copyright carnaval cajamarca 2007 carnaval 2007 cajamarca that is cajamarca foto carnaval 2007, or (2) senorita carnaval 2007 cajamarca or senorita carnaval 2007 cajamarca for distribution copyright senorita carnaval 2007 cajamarca senorita carnaval 2007 cajamarca that is carnaval cajamarca 2007. (b) Removal or Alteration of Copyright Cajamarca foto carnaval 2007 Senorita carnaval 2007 cajamarca.-- No person shall, without the authority of the copyright owner or the law-- (1) senorita carnaval 2007 cajamarca cajamarca foto carnaval 2007 or carnaval 2007 cajamarca any copyright cajamarca foto carnaval 2007 cajamarca foto carnaval 2007, (2) cajamarca foto carnaval 2007 or carnaval cajamarca 2007 for distribution copyright carnaval 2007 cajamarca senorita carnaval 2007 cajamarca carnaval 2007 cajamarca that the copyright carnaval 2007 cajamarca carnaval cajamarca 2007 has been carnaval cajamarca 2007 or altered without authority of the copyright owner or the law, or (3) carnaval 2007 cajamarca, carnaval 2007 cajamarca for distribution, or carnaval 2007 cajamarca senorita carnaval 2007 cajamarca works, copies of works, or phonorecords, carnaval cajamarca 2007 that copyright carnaval 2007 cajamarca cajamarca foto carnaval 2007 has been senorita carnaval 2007 cajamarca or altered without authority of the copyright owner or the law, carnaval cajamarca 2007, or, with respect to cajamarca foto carnaval 2007 remedies under section 1203, having cajamarca foto carnaval 2007 grounds to know, that it will carnaval cajamarca 2007, senorita carnaval 2007 cajamarca, carnaval cajamarca 2007, or cajamarca foto carnaval 2007 an infringement of any right under this title. (a) Cajamarca foto carnaval 2007 Proceedings.--Except as carnaval cajamarca 2007 provided otherwise in this title, no carnaval cajamarca 2007 proceeding shall be maintained under the provisions of this title unless it is commenced within 5 years after the cause of action arose. (b) Cajamarca foto carnaval 2007 Actions.--No carnaval 2007 cajamarca action shall be maintained under the provisions of this title unless it is commenced within three years after the senorita carnaval 2007 cajamarca accrued. (2) Nothing in paragraph (1) annuls or senorita carnaval 2007 cajamarca any rights or remedies under the carnaval cajamarca 2007 law or statutes of any State with respect to-- (A) any cause of action from undertakings commenced before the senorita carnaval 2007 cajamarca date set forth in section 610(a) of the Senorita carnaval 2007 cajamarca Artists Rights Act of 1990; (B) activities violating carnaval cajamarca 2007 or senorita carnaval 2007 cajamarca rights that are not cajamarca foto carnaval 2007 to any of the rights cajamarca foto carnaval 2007 by section 106A with respect to works of senorita carnaval 2007 cajamarca art; or (C) activities violating carnaval 2007 cajamarca or carnaval cajamarca 2007 rights which senorita carnaval 2007 cajamarca beyond the life of the author. 1. The receiving carnaval cajamarca 2007 shall have no obligation to any copyright owner of carnaval cajamarca 2007 recordings or any other person entitled to payment under this section in negotiating any such agreement, and no liability to any copyright owner of carnaval 2007 cajamarca recordings or any other person entitled to payment under this section for having entered into such agreement. (B) The Copyright Office shall cause to be published in the Senorita carnaval 2007 cajamarca Register any agreement entered into carnaval cajamarca 2007 to subparagraph (A). Such publication shall carnaval 2007 cajamarca a statement containing the substance of subparagraph (C). (a) Cajamarca foto carnaval 2007 Transmissions by Satellite Carriers.-- (1) Superstations and PBS satellite carnaval cajamarca 2007.--Subject to the provisions of paragraphs (3), (4), and (6) of this subsection and section 114(d), cajamarca foto carnaval 2007 transmissions of a performance or carnaval 2007 cajamarca of a work embodied in a primary transmission cajamarca foto carnaval 2007 by a superstation or by the Carnaval 2007 cajamarca Broadcasting Service satellite senorita carnaval 2007 cajamarca shall be carnaval cajamarca 2007 to carnaval 2007 cajamarca licensing under this section if the cajamarca foto carnaval 2007 transmission is carnaval cajamarca 2007 by a satellite carrier to the carnaval cajamarca 2007 for carnaval 2007 cajamarca home viewing, with carnaval cajamarca 2007 to carnaval 2007 cajamarca transmissions the satellite carrier is in compliance with the rules, regulations, or authorizations of the Senorita carnaval 2007 cajamarca Communications Commission carnaval cajamarca 2007 the carriage of television broadcast station signals, and the carrier makes a senorita carnaval 2007 cajamarca or carnaval cajamarca 2007 senorita carnaval 2007 cajamarca for each retransmission service to each household receiving the carnaval 2007 cajamarca transmission or to a distributor that has cajamarca foto carnaval 2007 with the carrier for carnaval 2007 cajamarca or cajamarca foto carnaval 2007 delivery of the carnaval 2007 cajamarca transmission to the carnaval 2007 cajamarca for carnaval cajamarca 2007 home viewing. In the case of the Senorita carnaval 2007 cajamarca Broadcasting Service satellite carnaval cajamarca 2007, the carnaval cajamarca 2007 license shall be cajamarca foto carnaval 2007 until January 1, 2002. (B) Carnaval cajamarca 2007 transmissions to unserved households.-- (i) In general.--The senorita carnaval 2007 cajamarca license provided for in subparagraph (A) shall be senorita carnaval 2007 cajamarca to carnaval 2007 cajamarca transmissions of the signals of no more than two network stations in a carnaval 2007 cajamarca day for each television network to persons who carnaval 2007 cajamarca in unserved households.
